I am very grateful to let you know that there are now more than 2,000 signatories to the new coalition letter which aims to prevent State Health Commissioner Nirav R. Shah from fulfilling his 2/12/13 pledge to complete a Review of the Public Health Impact of High Volume Hydraulic Fracturing "within a few weeks."

The release of the coalition letter generated extensive press coverage and sent a powerful, unmistakable message to the Governor. See below. I invite you to check out the signatories. That is one mighty impressive coalition. Thank you all so much.

So long as this bogus DOH Review is not completed, a Final Supplemental Generic Environmental Impact Statement (SGEIS) cannot be adopted and New York's Shale Gas Fracking moratorium will remain in effect.

Keep Slugging

Governor Cuomo still adamantly refuses to fulfill the coalition letter's request to require public notice regarding the intent of his DOH Review. He has not required any opportunity for public review or comment. He will not hold even one public hearing to receive testimony about how DOH should conduct its Public Health Impact Review.

Anyone who thinks that the Governor should be lauded for taking a time-out to conduct a Public Heath Impact "Study" is simply confused. There is no DOH Study underway. There is no time-out.

The Cuomo administration still appears to be barreling full-steam ahead to complete its bogus DOH Review, adopt a Final SGEIS and begin issuing shale gas fracking permits. There is not a shred of hard evidence to contradict that grim scenario.

Push Harder Than Ever

Despite DEC's failure to complete its shale gas Revised Rulemaking Proposal by the 2/27/13 deadline, we desperately need to intensify the pressure on Governor Cuomo. The sham DOH Review could be finished any day. If that happens, a Final SGEIS could be adopted and New York's shale gas moratorium could be lifted only ten days later.

The Inadequate and Incomplete DOH Review Could be on the Verge of Completion

On 2/12/13, Dr. Shah wrote: "I anticipate delivering the completed Public Health Review to you [Martens] within a few weeks, along with my recommendations (emphasis added)."

Joe Martens stated that DEC could adopt a Final SGEIS after the DOH Review is completed if Shah raises no objections.

Shale gas extraction permits could be issued after a mere ten-day comment period. More than 50 permit applications are in the pipeline.

Take Urgent Action Today

First and foremost, call and email your Assembly and State Senate Representatives. If they are not one of the 65 signatories to Assemblywoman Barbara Lifton's Letter calling for Formal DOH Review Public Participation, please ask them to become one. We need to build maximum support for this letter in the Legislature.
