Plan of Action Until Election Day/More Amazingly Powerful Letters Sent to Andrew Cuomo/Prominent Fractivists Respectfully Write Green Groups

Greetings,

Congratulations on yet another day without even one fracked shale gas production well anywhere in New York.

As you will see from the Primary Election clips below, we succeeded beyond all expectations in making Marcellus Shale fracking a critical reelection issue for Andrew Cuomo. Fractivists are repeatedly credited with playing a key role in helping Zephyr Teachout win an unprecedented share of Gubernatorial Primary votes.

I write today to outline how we can use that achievement to our best advantage in the weeks to come.

Keep Cranking up the Pressure

There can be no doubt that Andrew Cuomo wants to permit shale fracking in New York State. Otherwise, he would have "kicked the can down the road" years ago.

Moreover, Andrew Cuomo clearly wants to win this fight very badly or he would not have endured the political hammering he has received virtually every day of his administration.

It is imperative to require Andrew Cuomo to halt both his secret DOH "review" and his outdated Draft Supplemental Generic Environmental Impact Statment (SGEIS). If a comprehensive "Public Health Impact Study" can be required to be undertaken, there would be no shale fracking in New York for many years to come, if ever.

More Amazingly Focused and Powerful Citizen Letters Sent To Andrew Cuomo

The general consensus in politics is that the most potent citizen advocacy tool is a well-written personal letter. That is why I am immensely pleased to share with you dozens of powerful and wonderfully informed letters that recently barraged Andrew Cuomo.

These super-focused letters echo the same "ask" and have undoubtedly packed a wallop. They belie Andrew Cuomo's assertion that Fractivists are merely "passionate" protesters who do not understand the science that he promises to base his final fracking decision on.

Important New Letter From Prominent Fractivists

I also bring to your attention an extraordinarily important letter sent by prominent Fractivists to five major environmental organizations: Environmental Defense Fund, Natural Resources Defense Fund, Sierra Club, Riverkeeper and Environmental Advocates.

These environmental organizations have clout because their annual budgets exceed a total of $200 million. They often declare that they "stand with the grassroots." Yet they have repeatedly declined to join more than 50,000 signatories to various coalition letters that have been instrumental in extending New York's de facto shale fracking moratorium since 2008.

The respectful letter speaks for itself. I urge all Fractivists to read it: http://www.toxicstargeting.com/sites/default/files/letter_140919.pdf

If this request receives a favorable reply, it would enormously intensify the pressure on Andrew Cuomo to halt the SGEIS proceeding. That has been our strategic goal for five long, hard years.

If these organizations decline to become signatories, their decision would speak volumes to grassroots Fractivists in New York and across the nation.

Take Urgent Action Until Election Day

The fate of shale fracking in New York could very well be decided in the weeks to come.

Keep calling and emailing Andrew Cuomo in order to kill both the DOH "review" and Draft SGEIS.

Request that a comprehensive shale fracking "Public Health Impact Study" be conducted openly and transparently with full public participation.

Tell Andrew Cuomo that you will "remember in November."

Personalized Letters Sent to Governor Cuomo Requesting That Both the DOH “Review” and the Draft SGEIS be Halted

See full letter at: http://apps.toxicstargeting.com/ms_email_template.php

Concern over Fracking
Dear Governor Cuomo:

My name is Elizabeth C. I write today because I voted for Zephyr Teachout and want you to know that although I am a registered Democrat, you are not assured of my vote. Although this is a "form" letter, I'm using it because it sums up my position.

I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

NO VOTE IF YOU CONTINUE TO SUPPORT FRACKING
Dear Governor Cuomo:

My name is Professor Kristin L. I write today because YOU ARE IGNORING THE DESIRES OF YOUR CONSTITUENTS, AND ENDANGERING THE ENVIRONMENTAL HEALTH OF NYS, AS WEL AS THE PHYSICAL HEALTH OF HEW YORK RESIDENTS, WITH YOUR STANCE TO ALLOW FRACKING IN NEW YORK STATE. IF YOU DO NOT CHANGE YOUR STANCE BEFORE THE ELECTION, YOU WILL LOSE MANY VOTES (you saw what happened in the primary, with opponents who promised to ban fracking immediately upon election!), INCLUDING ABOUT 10 FROM MY FAMILY, FOR WHOM THIS ISSUE CURRENTLY DWARFS ALL OTHER CAMPAIGN ISSUES.

I request that YOU PUBLICLY AND QUICKLY STATE THAT YOU WILL NO LONGER SUPPORT FRACKING IN THE MARCELLUS SHALE. Barring that (as I know you are unlikely to make what WOULD be a very smart campaign move on your part), I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

Do you want my vote?
Dear Governor Cuomo:

My name is Annie C. I write today because I want you to know that you have lost my vote unless you withhold adoption of a Final SGEIS and refrain from permitting any shale gas extraction in New York. Thank you!

I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

Public Health Effects of Hydrofracking
Dear Governor Cuomo:

My name is Shyama O. I write today because I depend upon you to protect New Yorkers from the harmful effects of hydrofracking. As a voter, I cannot support any candidate who overlooks these effects in planning for the future of shale gas extraction in New York State.

I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

Your support of shale gas extraction will send my vote to Howie Hawkins
Dear Governor Cuomo:

My name is Anna C. I write today because I want you to know how important it is to me that Shale Gas fracking does not happen in New York state. I feel so strongly about this that I will vote for Howie Hawkins in the upcoming election unless your stance on fracking shifts considerably. There are economic gains to be made with solar, wind, and geothermal energy development. That's where I want to see our state heading.

Barring a permanent moratorium on fracking, which is what I really want to see, I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

Without sending a full form letter I want to let you know that I echo the sentiments of the leaders at Toxics Targeting that a comprehensive, OBJECTIVE, transparent public health study must be completed before any decision is made.

Even if a comprehensive set of laws and safeguards to protect against environmental and public health risks associated with fracking is put into place, mistakes will be made, companies will pay fines, and it will just continue anyway. It's not worth it. There are other better ways to produce energy and provide economic support for our state.

Your decision guides my decision at the polls
Dear Governor Cuomo:

My name is Brenda L. I write today because of my concerns about our environment.

I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

I am also concerned of the effect on climate change when all the co2 and methane sources are considered. N.Y has already suffered the effects of Sandy. Let us not increase these disasters by public policy that does not adequately review the effect of our actions.

I request that you maintain New York's Marcellus Shale gas extraction moratorium until your Acting Department of Health (DOH) Commissioner, Dr. Howard Zucker, completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

Marcellus Shale Gas Extraction Moratorium
Honorable Andrew M. Cuomo
Governor of New York
The State Capitol Building
Albany, NY 12224

Dear Governor Cuomo:

I am writing to urge you to maintain New York's Marcellus Shale gas extraction moratorium until the Department of Health completes a comprehensive Public Health Impact Study of High Volume Hydraulic Fracturing (HVHF).

The recent DOH Review should be scrapped because it was conducted in secret without any public input, which would have brought testimony from Pennsylvania residents who have seen their water contaminated from these activities, among others.

In order to make sure that shale gas fracturing does not endanger public health in New York, any Public Health Impact Study must require formal public participation, including: 1) written public notice of the intent/scope of the study; 2) at least a 30-day public comment period to afford ample opportunity for public review and comment; and 3) at least one public hearing to allow interested parties to testify about how the DOH Public Health Impact Study should be conducted.

It also must resolve all of the fundamental shortcomings of DEC's Revised Draft Supplemental Generic Environmental Impact Statement (SGEIS) by documenting the broad spectrum of toxic and persistent pollutants generated by HVHF activities; the environmental fate and transport mechanisms associated with the toxic and persistent pollutants generated by HVHF activities; known and potential public exposures to toxic and persistent HVHF pollutants, including: contaminant concentrations; exposure duration; an assessment of all potential public health consequences; and whether the Draft SGEIS adequately safeguards public health from HVHF toxic pollution threats.

Please note that more than 5,000 signatories to five major coalition letters request that you immediately put on-hold completion of your DOH Review of HVHF. Those signatories include Assembly and State Senate Representatives, local government officials, civic and environmental groups and concerned citizens.

I personally know that at least one DEC engineer in the associated office is personally in favor of fracking and has asserted to numerous individuals that there are no current studies that show that fracking chemicals have gotten into water tables. This is clearly not true and I really hope that other employees at DEC assigned to this issue conduct a thorough review of the evidence and not just rely on industry studies, which I find intellectually lazy at best and dishonest at worst.

This is particularly important given the water contamination issues reported in some Pennsylvania towns, the earthquakes documented around the country by university-based researchers, and the media reports of livestock deaths in fracking areas in the Midwest.

The people of this State deserve an unbiased review of ALL the evidence, and the creation of sustainable economic development initiatives in the affected areas, not these kinds of polluting activities that raise environmental justice issues instead.

Until the Department of Health completes the comprehensive Public Health Impact Study in fulfillment of the DEC Commissioner's own mandates, I request that you withhold adoption of a Final SGEIS and refrain from permitting any shale gas extraction in New York.

It would be irresponsible to permit shale gas extraction in New York based on a fatally flawed DOH review conducted completely in secret and originally involving only 25 hours of work by three outside consultants. That kind of effort has "whitewash" written all over it.

Thank you for your consideration. I look forward to your prompt reply to my request.

Sincerely,

Dr. Elizabeth C
Albany NY 12210
