Dear Officials,
I am writing to update you on Dominion’s progress with the New Market Project.
As you may already be aware, New York State Department of Environmental Conservation (DEC) issued the three Air State Facility Permits for the project in late December 2016.
During these past months, Dominion has been working with the DEC and MS4 Officials on final Stormwater Pollution Prevention Plans (SWPPP) for the locations of the project. We have also been working with local governments to secure building permits for the construction activities.
After receiving site plan approvals in the various locations of the project and SWPPP approvals where necessary, Dominion recently filed a Variance Request and Request for Notice to Proceed with the Federal Energy Regulatory Commission (FERC). I have attached a PDF of the document for your records.
The variance request filed with FERC was necessary to provide the FERC with the final facility design that was approved by local planning boards in the time period since the original application was filed with FERC back in June of 2014.
Due to the evolution of the project as local reviews, including the local CAG processes, planning board reviews and SWPPP approvals worked to their conclusion, it was necessary to supplement prior filings with the FERC. This is a routine occurrence in permitting scenarios and such is the case in this project.
A high level sequence of routine events may be helpful. This is how the process typically goes:
1) File FERC application with a very high level design
2) Complete detailed facility design
3) Seek and obtain local approval with final design documents. (Sometimes this local approval process also necessitates design changes as was the case with this project)
4) Give FERC the final facility design that was approved locally via the variance request
In no way is this FERC filing new information to the localities of the project. The various Planning Boards have seen and approved this information, and stormwater and erosion controls were most recently approved during the SWPPP process.
We’ve appreciated the thorough review and kind working relationship we’ve established during this process with all of you. We look forward to working with you as we complete the project and put the facilities into service to benefit New Yorkers, both upstate and downstate.
