After sending out my last alert, I spoke to multiple environmental law experts who have closely followed High-Volume Hydraulic Fracking events since the beginning of our battle to keep New York 100% free of Marcellus Shale natural gas and oil extraction.
I had two concerns. I inquired about the adequacy of State legislation (S8357 and A8866) that would prohibit issuing permits that use carbon dioxide to "complete or recomplete natural gas or oil resources." I also asked about Carbon Capture and Sequestration programs.
First, the attorneys expressed grave concerns that the limited language of the carbon dioxide prohibition legislation could face legal challenge if enacted into law.

Third, the attorneys reviewed the U. S. Environmental Protection Agency's proposed Carbon Capture, Utilization and Sequestration/Storage Rules and believe they raise concerns that carbon dioxide could be permitted to be stored in New York shale formations pursuant to federal authority.
Profoundly Disturbing Hydrofracking Revelation
I will follow up shortly about the profoundly disturbing implications associated with proposed Carbon Capture and Sequestration programs. I now believe New York's High-Volume Hydraulic Fracturing Prohibition was very likely limited to 300,000 or more gallons of water in order to permit massive Carbon Capture and Sequestration efforts associated with injecting carbon dioxide into Marcellus Shale.
This activity might permit carbon dioxide to be used to extract natural gas and oil from our state's shale formations while defining the process as Carbon Sequestration/Storage or Utilization pursuant to federal authority.
I will shortly document that unprecedented Carbon Capture and Sequestration programs have been planned and proposed in New York for more than 15 years.

It is inarguable that the New York State Department's Final Supplemental Generic Environmental Impact Statement concluded that no High-Volume Hydraulic Fracturing should be permitted in our state in order to safeguard public health and the environment.
Fractivists must achieve this goal without fail and with no margin for error or the consequences could be horrific.

I request that Governor Hochul immediately adopt a comprehensive 100% prohibition of all forms of High-Volume Hydraulic Fracturing using water and non-water methods, including carbon dioxide, nitrogen, liquefied petroleum gas or any other substances, combined with horizontal drilling."
