Due to recent developments in the Presidential Campaign, I write to request that you take urgent, immediate action to make sure that Governor Hochul keeps New York 100% free of all forms of shale fracking combined with horizontal drilling in order to prevent Carbon Dioxide natural gas extraction proposed in New York's Southern Tier region. I cannot overemphasize the importance of my request.

Presidential Candidates Harris and Trump Both Reportedly Support Shale Fracking

Presidential candidates Kamala Harris and Donald Trump have both emphatically stated that they support High-Volume Hydraulic Fracturing that has made our nation the world's largest producer of oil and natural gas. This is a hugely important political issue in the key battleground state of Pennsylvania that could decide the upcoming election.

Presidential support for shale fracking could result in either shale fracking in New York or injection of Carbon Dioxide as part of Carbon Storage and Sequestration efforts that could have the same devastating public health and environmental consequences.

High-Volume Hydraulic Shale Fracking Using Carbon Dioxide Could Be Permitted Any Time in New York's Southern Tier

Vast High-Volume Hydraulic Shale Fracturing using Carbon Dioxide could begin any day in New York because the State's 2015 shale fracking prohibition is limited to: "the stimulation of a well using 300,000 or more gallons of water (emphasis added) as the base fluid for hydraulic fracturing for all stages in a well completion, regardless of whether the well is vertical or directional, including horizontal." In short, the fracking prohibition is limited to hydrofracking.

Proposed Carbon Dioxide Shale Fracking Legislation is Fatally Flawed and Must Not Be Enacted Into Law

Fatally flawed legislation that purports to prevent using carbon dioxide to "complete or recomplete natural gas or oil resources" has passed the State Assembly and State Senate, but Governor Hochul has not enacted the bill into law.

We must make sure that the Governor does not sign the bill because it is totally inadequate. The legislation simply adds the words, "or carbon dioxide" to State law, BUT NOT AS PART OF THE DEFINITION OF NEW YORK'S HIGH-VOLUME HYDRAULIC FRACTURING PROHIBITION.

The legislation is bogus because it would not specifically prohibit Carbon Dioxide High-Volume Hydraulic Shale Fracturing. Injecting Carbon Dioxide into Marcellus Shale could be considered Carbon Storage and Sequestration, not a permitted activity to "complete or recomplete natural gas or oil resources." The legislation also would not prohibit all forms of High-Volume Hydraulic Fracturing, such as using nitrogen, propane, natural gas or even water one gallon less than the current 300,000 gallon limit.

Conclusion

Governor Hochul reportedly just pledged that “we’re not fracking” in New York. The problem is that she did not say how this would be achieved.

We must take action now or our state could be fracked. We must not make the same mistakes that resulted in Andrew Cuomo's shockingly inadequate 2015 fracking prohibition.
